Terms of Sale (TOS)

These TOS govern the sale of One Shot credits and the use of the Besta Pro Space by establishments.

1. Presentation

Besta publishes a SaaS platform (Pro Space) allowing establishments to publish events on the public mobile app. Website: https://www.besta-app.fr/ Contact: contact@besta-app.fr Besta also operates a ticketing marketplace allowing establishments to sell tickets to third-party buyers, acting as a platform operator within the meaning of Article L. 111-7 of the French Consumer Code.

2. Products and offers

Besta offers:

One Shot single credit:

€6 incl. VAT (20% VAT included) per credit, usable to publish a simple event.

Important notes:

  • Pro and Business monthly subscriptions are modifiable: you can switch from one subscription to another by paying pro-rata.
  • Users can manage, modify or cancel their subscription from the Stripe customer portal.
  • Each credit is fully consumed when an event is published; it is not possible to use a credit partially.
  • Credits have no expiration date, except where otherwise stated in connection with a promotional offer or specific plan.

Details about Besta Partner Plan:

Allows publishing 1 premium event with maximum visibility for 60 days (social media, notifications, app, email). The premium credit of the Partner plan can only be used once.

Users retain all Partner plan benefits (statistics, tracking, visibility) indefinitely, but only for this unique premium credit. After using the premium credit, the user retains access to the statistics of their published event indefinitely.

Once this credit is used, users can:

  • Re-purchase a new Partner plan to benefit again from a premium event with the same advantages.
  • Purchase a standard credit (simple event) that does not benefit from premium visibility.
  • Switch to a Besta Pro or Business subscription to publish multiple events per month according to the subscription quota.

2.bis Integrated Ticketing

Besta offers an integrated ticketing module allowing establishments to sell tickets to third-party buyers.

Subscription conditions: — The establishment must create and connect a Stripe account (Stripe Connect) from their dashboard. Without this step, ticketing cannot be activated.

Business model: — Payments are collected directly by the establishment via Stripe Connect. — Besta charges a commission whose rate is determined by the plan active at the time the ticketing is created (rate locked, even if the plan changes later):

  • Besta Free: 7% + €0.30 / ticket
  • Besta Pro: 6% + €0.25 / ticket
  • Besta Business: 5% + €0.20 / ticket
  • Besta Partner: 3% + €0.10 / ticket

— Stripe fees apply in addition (1.5% + €0.25 for domestic cards, variable for international/premium cards).

Establishment responsibilities: — The establishment is the ticket seller and event organizer. — It is solely responsible for holding the event, ticket validity, and any refunds in case of cancellation or postponement. — In case of event cancellation, the establishment must fully refund buyers as soon as possible.

Promo codes: — The establishment can create promo codes (percentage or fixed-amount discount, with configurable maximum uses and optional expiry date).

3. Payment

All payments are made via Stripe, secure and PCI DSS compliant.

Amounts are billed in euros (€) and include 20% VAT.

The subscription is automatically renewed each month, unless cancelled by the customer from their Stripe portal.

  • B2B payments (credits, subscriptions): made by the establishment to Besta via Stripe.
  • Ticketing payments (B2C): made by buyers directly to the establishment via Stripe Connect. Besta charges a commission based on the plan active at ticketing creation.

4. Credit and subscription usage

Each published event consumes one credit.

Credits are linked to the professional account and are neither assignable nor transferable.

For subscriptions, monthly quotas are reset on the 1st of each month.

Unused credits or events are non-refundable.

Credit types: There are several credit types — Normal (standard event publication), Premium (publication with enhanced visibility), Partner (premium event 60 days, usable once per plan). The required type depends on the event type and subscribed plan.

5. Refund policy

Except in the case of confirmed double payment, no refund is granted.

In case of confirmed double payment, the refund will be made via the same payment method within a maximum of 14 days after verification.

5.bis Ticket buyer personal data

The establishment is informed that, in the context of ticketing, it has access via its dashboard to the following buyer data: email, name (if nominative ticket), date of birth (if enabled), amount paid, reservation status. It can export this data as CSV. As a data recipient, the establishment agrees to process this information in accordance with GDPR and not to use it for any purpose other than ticket management and event access control.

6. Responsibility

Besta makes every effort to ensure the availability of Pro Space and proper execution of services. Besta is not responsible for publication errors, service interruptions, or data loss due to misuse by the establishment.

7. Modification of TOS

Besta may modify these TOS or service features at any time. Users will be informed of changes via the website or platform. Continued use of the service implies acceptance of the new TOS.

8. Applicable law and jurisdiction

These TOS are governed by French law. Any dispute will be submitted to the competent courts of Paris.
